Terms of Service

These Terms of Service ("Terms") govern your use of the Shelf Life mobile application ("the App"), published by Positor Group LLC ("we", "us", "our"). By installing or using the App, you agree to these Terms. If you do not agree, do not use the App.

License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for your own non-commercial use, subject to these Terms and the Apple Media Services Terms and Conditions.

Your responsibilities

You are responsible for any content you add to the App, including any epub files you import or download through it. You agree to use the App only with content you have the legal right to access and store. You will not use the App to infringe copyright, distribute unlawful material, or violate any applicable law.

The App's "Send to Kobo" feature runs a temporary web server on your local Wi-Fi network. You are responsible for the network you operate it on and for the devices you transfer files between.

Third-party services

The App queries public book catalogs (such as OpenLibrary and Google Books, the latter accessed through a proxy we operate) to look up book metadata. Use of those services is subject to their own terms. We are not responsible for the availability or accuracy of third-party data.

Disclaimer

The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that any data stored in it will be preserved.

Limitation of liability

To the maximum extent permitted by law, Positor Group LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of your use of the App. Our total liability for any claim relating to the App will not exceed the amount you paid for it, which for most users is zero.

Termination

You may stop using the App at any time by deleting it from your device. We may suspend or discontinue the App, in whole or in part, at any time without notice.

Changes

We may update these Terms from time to time. The current version will always be posted at this URL with a new effective date. Continued use of the App after a change means you accept the revised Terms.

Governing law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the App will be resolved exclusively in the state or federal courts located in New York, New York.
